KOO COINS TERMS AND CONDITIONS

The Koo Coin Loyalty Rewards Promotion (Promotion) is operated by Bombinate Technologies Pvt. Ltd. (No. 849, 11th Main, 2nd Cross, HAL 2nd Stage, Indiranagar, Bangalore, Karnataka – 560008 U72900KA2015PTC084475) hereinafter referred to as “Promoter”. 

For the purposes of these Terms & Conditions, “user” or “users” refers to registered users of the Koo App. Capitalised terms not defined in these Koo Jackpot Terms have the same meaning as set out in the Koo Terms of Service.

PROMOTION: As part of the Koo Coin Loyalty Promotion, the Promoter is rewarding users of the Koo App with Koo Coins on

1. Completion of Koo Daily Check-In, or
2. Completion of Any Other Promotional Activity, as determined by Promoter from time to time.

This promotion is currently available only in select geographies. Please update to the latest version of the Koo App to check for availability.

Completion of a Daily Check-In:

Koo Daily Check-In means an action by a user of logging into their Koo account, on a mobile device or the web, and staying logged in and viewing content every day between 12 am and 11:59 pm as per time spent requirements listed in the Daily Goals section of the Koo Rewards Centre.

The time spent is measured by a time counter which measures the time spent in a 24-hour window every day from 12 am to 11:59 pm. The time spent is displayed in the Koo Rewards Centre. At the end of the 24 hours, if a user has spent the required time, corresponding Koo Coins are awarded and the counter resets to zero. 

The rate of award of Koo Coins may change from time to time at the discretion of the Promoter. The current applicable rate is displayed in the Koo Rewards Centre.

At its discretion, the Promoter may also reward Koo Coins for consecutive Daily Check-Ins as stated in the Koo Rewards Centre. If consecutive Daily Check-Ins are not completed, Koo Coins earned for that session are reset. The next Daily Check-In after the break will be considered as a 1st Daily Check-In and points will be awarded accordingly.

No rewards are granted if a user (i) Clears their cache, or (ii) uninstalls the Koo App, or (iii) Logs out of the Koo App, or (iv) Acts in violation of these Terms & Conditions

Completion of Other Promotional Activity announced from time to time:   

Koo Coins may also be awarded to users for participating in other promotional programs (like Koo Jackpot)  announced by the Promoter from time to time. The terms and conditions of each program shall be displayed to the users when the program is announced or in the Koo Rewards Centre.

ELIGIBILITY & AVAILABILITY:  Koo Coins are not available to users who:

(i) Have not installed the latest version of the Koo App

(ii) Are not resident of the territory where they are available

(iii) Do not have internet access on a compatible device

(iv) Do not agree to these Terms and Conditions

(v) Use unfair means of earning Koo Coins including but not limited to cloning apps, multiple IDs, multiple accounts or similar unfair methods

The Koo App is available for use without subscribing to Koo Coin loyalty rewards promotion or Koo Daily Check-In. In other words, it is not compulsory to do a Koo Daily Check or take part in Promotional activity to access the features of the Koo App. However, it is necessary to do a Koo Daily Check-In or take part in Promotional Activity, to earn Koo Coins.

Employees of the Promoter and their direct family members are not eligible to participate in the Promotion or earn Koo Coins. If any such transactions are discovered or reported, the same will be reversed.

The Koo Coins reward program is available to only one Koo account per user. If a user creates multiple Koo accounts on single or multiple devices, the rewards program will be withdrawn from all such accounts. 

PROMOTION PERIOD: The Koo Coins loyalty rewards promotion is operational from 31 March 2023 to 31st December 2023 (“Promotion Period”). However, the Promoter reserves the right to terminate or extend the Promotion at any time by giving an in-app notification. 

Any Koo Coins accrued up to the point of termination shall be credited and may be redeemed in accordance with the terms of the Promotion. Koo Coins can also be redeemed

KOO COINS ACCRUAL: Koo Coins will be awarded in the manner and subject to the conditions set out in clause 1 above. 

All accrued Koo Coins will immediately lapse and cannot be redeemed if a user does any of the following:

(i) User clears the cache

(ii) Uninstalls the Koo app

(iii) Logs out

(iv) Employs unfair, unwarranted and undesirable methods to earn Koo Coins

(v) Acts in violation of these Terms & Conditions

Users will be able to access their Koo Coins earnings, spending, lapse or balance in the Rewards Centre. You will also be notified of any earnings, spending or lapse of Koo Coins through the in-app notification feature. 

If a user has earned Koo Coins, they will be able to see them in a dashboard in the Rewards Centre. 

REDEMPTION: Koo Coins can be redeemed into rewards or coupons or vouchers or other goods or services at the discretion of the Promoter. The Promoter reserves the right to change this redemption method and manner by providing an advance in-app notification. From time to time Promoter may prescribe the minimum amount that may be redeemed.

Redemption is enabled when a user clicks the “Withdraw” button and follows the on-screen instructions for withdrawal or redemption. 

NO WARRANTY OR FITNESS FOR PURPOSE: Redemption of Koo Coins for rewards or coupons or vouchers shall be in the manner prescribed by the Promoter. Vouchers are provided by the Promoter at its sole discretion and for the value prescribed by the Promoter.

NO RESPONSIBILITY:  Promoter has no responsibility for the quality or characteristics of any goods or services availed on redemption of the vouchers. Only the merchants are fully responsible for the goods and services, without any reference to Koo. Koo disclaims complete responsibility for any deficiency in goods or services availed on redemption of the rewards or coupons or vouchers. Users must satisfy themselves completely of fitness or usage of the goods or services.  

EXPIRY: Koo coins awarded shall expire as per the expiry period stated in the Rewards Centre, from time to time or as determined by Promoter at its discretion without any compensation or notice.

Koo Coins are loyalty rewards and only a limited amount is set aside for redemption. Redemption is facilitated on a first come first serve basis. Some users, who do not redeem awards after being granted Koo Coins, may miss out on the benefits. In accordance with reward program requirements, Koo coins are made available equally to all users. An expiry date helps to recirculate the limited rewards among users who are more interested in this program. Koo Coins can be rescinded or withdrawn or canceled at any time without notice or compensation.

NO LIABILITY FOR EXPIRED OR INVALID VOUCHERS: any other rewards or coupons or vouchers shall have an expiry date and Koo shall have no responsibility for expired vouchers vouchers which are deemed invalid by merchants. Users are responsible for redeeming or using their rewards or coupons or vouchers. Promoter shall not be considered to be in breach of its obligation for voucher redemption as a result of the occurrence of a Force Majeure Event (defined below).

FORCE MAJEURE EVENT:  Force Majeure Event means any event, whatever the origin, not within the reasonable control of the Promoter and which the Promoter is unable to prevent, avoid or remove or circumvent.

Force Majeure events shall include, but shall not be limited to, acts of god, acts, orders, directions of governmental/ regulatory/ judicial/ quasi-judicial/ law enforcement authorities/ agencies, war hostilities, armed conflict, sabotage, pandemic, epidemic, hacking, the act of foreigners, insurrection, outages or downtimes or systems failures experienced by a service provider or a sub-service provider  or a redeeming merchant, hacking or man in the middle attack or similar attacks/ intrusions, revolution or usurped power, acts of terrorism, sabotage, nuclear explosion, earthquake or other similar activities.

In all such cases, any redemption shall be subject to the fulfillment of the obligations of any partners, banks/ financial institutions, counterparties and any other parties involved in or intrinsically linked to the redemption. 

Promoter shall not be liable for any amounts and shall have no payment obligations or any other obligations except for providing a replacement voucher at its discretion.

RESTRICTIONS ON PROMOTION & RIGHTS OF PROMOTER: The Promoter may deem a redemption as invalid, stop a user from entering/continuing to participate in this Promotion or stop a user from redeeming any Koo Coins or stop the redemption of rewards or coupons or vouchers if it considers, in its reasonable opinion, that the user is acting contrary to these Terms or has provided false information or is part of a fraud or fraudulent scheme or is abusing the Promotion in any way or acting in any other manner contrary to the spirit of the Promotion. 

The Promoter reserves the right to stop a user from entering/continuing to participate in this Promotion at any time. The Promoter reserves the right at any time to cancel, change or replace the Promotion due to any reason outside its reasonable control or if directed by law. 

USER INFORMATION & PRIVACY: In order to give effect to this Promotion, Promoter and its authorized representatives or service providers may store and process the information related to a user and other related information in order to calculate Koo Coin eligibility; for redemption and reconciliation and fraud detection. By continuing to take part in the Promotion and withdrawing the Koo Coins user gives their consent to the storage and use of such information in addition to the permissions already granted under Koo Privacy Policy.

LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES: TO THE FULLEST EXTENT PERMITTED BY LAW, BOMBINATE TECHNOLOGIES PVT. LTD. AND ITS AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THE PROMOTION OR FOR ANY ACTION OR OMISSION MADE IN CONNECTION WITH THE PROMOTION. WITHOUT LIMITING THE FOREGOING AND TO THE FULLEST EXTENT PERMITTED BY LAW, EVERYTHING IN THESE RULES AND THIS PROMOTION, INCLUDING THE PRIZES AWARDED, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

DISPUTE RESOLUTION: In case of any questions or concerns regarding these Terms and Koo Coins please write to redressal@kooapp.com.  All disputes in relation to these Terms shall be decided in accordance with the laws of India and subject to the exclusive territorial jurisdiction of the Courts at Bengaluru.
